Parents' Right to Know

What is this and Why It is Important? Federal law mandates for Title I, Part A funded schools that “Parents’ Right to Know” allows parents to request the professional qualifications of teachers and paraprofessionals. The following three actions must be implemented and documented by Title I schools and Title I Office by October 24, 2019. Definition of a Certified Teacher - properly certified for their teaching assignment as required by the South Carolina Department of Education (SCDE) Required Credentials Regulation. 1. Under the Federal guidance of Title I Part A, Parent Involvement, at the beginning of each school year, LEAs must inform parents of each student attending a Title I school of their right to request information about the professional qualifications of both the teachers and paraprofessionals who teach and work with their children. ELEMENTARY & SECONDARY EDUCATION ACT (ESEA) as amended by the EVERY STUDENT SUCCEEDS ACT Part A — Improving Basic Programs Operated by Local Educational Agencies SEC. 1112. STATE PLANS. (e) PARENTS RIGHT-TO-KNOW- (1) INFORMATION FOR PARENTS.— (A) IN GENERAL.—At the beginning of each school year, a local educational agency that receives funds under this part shall notify the parents of each student attending any school receiving funds under this part that the parents may request, and the agency will provide the parents on request (and in a timely manner), information regarding the professional qualifications of the student’s classroom teachers, including at a minimum, the following: (i) Whether the student’s teacher— (I) has met State qualification and licensing criteria for the grade levels and subject areas in which the teacher provides instruction; (II)is teaching under emergency or other provisional status through which State qualification or licensing criteria have been waived; and (III)is teaching in the field of discipline of the certification of the teacher. (ii) Whether the child is provided services by paraprofessionals and, if so, their qualifications. (B) ADDITIONAL INFORMATION.—In addition to the information that parents mayrequest under subparagraph (A) a school that receives funds under this part shall provide to each individual parent of a child who is a student in such school, with respect to such student— (i) information on the level of achievement and academic growth of the student, if applicable and available, on each of the State academic assessments required under this part; and (ii) timely notice that the student has been assigned, or has been taught for 4 or more consecutive weeks by, a teacher who does not meet applicable State certification or licensure requirements at the grade level and subject area in which the teacher has been assigned. Action: The Title I Office will place an advertisement in the local newspaper stating that “Charleston County School District is notifying parents of children in a Title I school, that they have the right to request information about the professional qualifications of both the teachers and the paraprofessionals who teach and work with their children in Title I Schools.” 2. Principals must attest in writing as to whether or not their school is in compliance with the requirements of certified teachers and highly qualifiedparaprofessionals. SEC. 1119. QUALIFICATIONS FOR TEACHERS AND PARAPROFESSIONALS. (i) VERIFICATION OF COMPLIANCE- (1) IN GENERAL- In verifying compliance with this section, each local educational agency, at a minimum, shall require that the principal of each school operating a program under section 1114 or 1115 attest annually in writing as to whether such school is in compliance with the requirements of this section. (2) AVAILABILITY OF INFORMATION- Copies of attestations under paragraph (1) — (A) shall be maintained at each school operating a program under section 1114 or 1115 and at the main office of the local educational agency; and (B) shall be available to any member of the general public on request. Action: Principals must generate an attestation letter on school letterhead as to whether they are in compliance or not. The Title I Office will provide the principals of Title I Schools with a formatted statement that the principals must (1) generate on the school’s letterhead, (2) sign and (3) file copies at the school, in the state Title I Crate (file A.5.1.1), and in the Title I Office. Deadline: October 24, 2019 3. Parents must be notified in writing from the school: (A) ADDITIONAL INFORMATION- In addition to the information that parents may request under subparagraph (A), a school that receives funds under this part shall provide to each individual parent— (B)(ii) timely notice that the parent's child has been assigned, or has been taught for four or more consecutive weeks by a teacher who is not certified. FORMAT- The notice and information provided to parents under this paragraph shall be in an understandable and uniform format and, to the extent practicable, provided in a language that the parents can understand. Action: Principals of Title I funded schools must notify parents in writing of teachers who do not meet applicable State certification or licensure requirements at the grade level and subject area in which the teacher has been assigned, paraprofessionals who do not meet the above qualification requirements and/or substitute teachers who are not certified that are teaching in core content areas. Formatted letters will be available on the CCSD Website under the Department of Federal Programs for principals to select the appropriate letter to use and send to the parents of students in such situations (also available on the Title I Intranet page, Title I Google Site page, and shared via the Principal’s Packet).
