When the parents of a child with a disability are divorced, separated, or unmarried, the parental rights under the IDEA apply to both parents, unless a court order or other state law specifies otherwise. 71 Fed. Reg. 46,568 (2006); and 34 CFR 300.30 (b)(1).Cuando los padres de un niño con una discapacidad están divorciados, separados o solteros, los derechos de los padres en virtud de la Ley de Educación para Individuos con Discapacidades (IDEA, por sus siglas en inglés) les aplican a ambos padres, a menos que una orden judicial u otra ley estatal especifique lo contrario.
